TITLE OF BILL:
An act to amend the education law, in relation to requiring schools to
accept credits for educational programs at office of children and family
services facilities as transfer credits
 
PURPOSE OR GENERAL IDEA OF BILL:
To provide for the transfer of coursework credits from OCFS operated
educational programs to local schools.
 
SUMMARY OF PROVISIONS:
Section one adds a new subdivision 1-a to Education Law § 112 to state
that credits awarded by educational programs in facilities operated by
OCFS shall be accepted as transfer credits by any school within New York
State. Section two provides for an immediate effective date.
 
JUSTIFICATION:
OCFS operates schools for the youth who are placed in their care. The
children who dedicate themselves to obtaining an education from these
facilities are often consolidated because the local school district they
are assigned to after they leave OCFS custody will very often refuse to
accept the educational credits they earned from the OCFS facility.
Currently, principals of hundreds of local schools are asked to make
case 'by case decisions about whether a child's credits will transfer.

EFFECTIVE DATE:
This legislation would take effect immediately.

AN ACT to amend the education law, in relation to requiring schools to
accept credits for educational programs at office of children and
family services facilities as transfer credits
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 112 of the education law is amended by adding a new
2 subdivision 1-a to read as follows:
3 1-a. Notwithstanding any other provision of law to the contrary, cred-
4 its awarded by educational programs provided by facilities operated by
5 the office of children and family services shall be accepted as transfer
6 credits by any school within the state of New York.
7 § 2. This act shall take effect immediately.
