  TITLE OF BILL: An act to amend a chapter of the laws of 2023 amending the public health law relating to municipal limited health care service facilities, as proposed in legislative bills numbers S. 6219 and A. 2400, in relation to the effectiveness thereof   PURPOSE: To make changes reflecting the length of time it will take to develop regulations related to municipal limited health care service facilities.   SUMMARY OF PROVISIONS: This bill amends Chapter 740 of the Laws of 2023 by providing the Department of Health with two years to develop regulations related to municipal limited health care service facilities.   JUSTIFICATION: Local health departments operate clinics to provide specified clinical public, health services, such as tuberculosis, sexually transmitted disease and immunization clinics. Currently, these clinics are subject to the full range of requirements Imposed on, hospitals and other full service diagnostic and treatment centers under Article 28 of the Public Health Law. To require compliance with these stringent requirements places unnecessary and crippling burdens on the limited service public health clinics operated by local health departments, threatening the ability of the local health departments to maintain these limited service clinics. This bill will maintain the requirement for the commis- sioner of health to develop a regulatory framework that makes sense for limited service public health clinics and permit their continued opera- tion so that .vital public health services may continue to be provided. To reflect the Department of Health's estimated timeline for the regula- tory and administrative process, the bill provides two years for the regulations to take effect, provided that actions necessary to implement this regulatory relief can take effect immediately.   LEGISLATIVE HISTORY: This is a new bill.   BUDGET IMPLICATIONS: None noted.   EFFECTIVE DATE: This act shall take effect immediately.

        AN ACT to amend a chapter of the laws of 2023 amending the public health
          law  relating  to municipal limited health care service facilities, as
          proposed in legislative bills numbers S. 6219 and A. 2400, in relation
          to the effectiveness thereof

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  2  of a chapter of the laws of 2023 amending the
     2  public health law relating to  municipal  limited  health  care  service
     3  facilities,  as  proposed  in  legislative  bills numbers S. 6219 and A.
     4  2400, is amended to read as follows:
     5    § 2. This act shall take effect [immediately] two years after it shall
     6  have become a law.    Effective  immediately,  the  addition,  amendment
     7  and/or repeal of any rule or regulation necessary for the implementation
     8  of this act on its effective date are authorized and directed to be made
     9  and completed on or before such effective date.
    10    § 2. This act shall take effect immediately.
