TITLE OF BILL:
An act to amend the public authorities law, in relation to requiring
cash lanes to be made available at certain toll barriers
 
PURPOSE:
To require at least one cash lane be made available to drivers at
certain toll barriers
 
SUMMARY OF PROVISIONS:
 
JUSTIFICATION:
The provision of electronic collection of tolls for certain highway
bridge and/or tunnel facilities offers significant benefits to the
majority of the motoring public, including increased customer conven-
ience, road congestion relief, cost reductions and enhanced traffic
management, but it could result in causing inconvenience, aggravating
congestion, increasing costs and lessening management control for motor-
ists who do not have electronic toll collection accounts. The proposed
legislation would insure at least one cash facility is available in
cities of 1,000,000 or more to motorists without electronic toll
collection accounts.
 
EFFECTIVE DATE:
This act shall take effect on the one hundred eightieth day after it
shall have become a law, provided, however, that the commissioner of
transportation is authorized and directed to promulgate any rules and
regulations necessary to implement the provisions of this act on or
before such effective date.

AN ACT to amend the public authorities law, in relation to requiring
cash lanes to be made available at certain toll barriers
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The public authorities law is amended by adding a new
2 section 1266-m to read as follows:
3 § 1266-m. Placement of electronic toll collection system lanes at
4 metropolitan transportation authority toll barriers located within a
5 city having a population of one million or more. The chairman of the
6 authority shall establish, by rule or regulation, requirements for the
7 placement of at least one cash lane to be made available for the
8 collection of tolls and fares where electronic toll collection systems,
9 as defined in subdivision twelve of section twenty-nine hundred eighty-
10 five of this chapter, have been designated at the toll barriers operated
11 by the metropolitan transportation authority at a toll highway, bridge,
12 tunnel or other thoroughfare located within a city having a population
13 of one million or more. Such rules and regulations shall specify the
14 general location of the roadway lanes in which cash lanes shall be
15 located.
16 § 2. This act shall take effect on the one hundred eightieth day after
17 it shall have become a law. Effective immediately, the addition, amend-
18 ment and/or repeal of any rule or regulation necessary for the implemen-
19 tation of this act on its effective date are authorized to be made and
20 completed on or before such effective date.
