TITLE OF BILL:
An act to amend the general municipal law, in relation to disabilities
of sanitation department employees caused by leptospirosis
 
PURPOSE:
Establishes a presumption with respect to leptospirosis which results in
disability or death for members of the uniformed force of a paid sanita-
tion department.
 
SUMMARY OF PROVISIONS:
Amends the general municipal law by adding a new section 207-aa.
 
JUSTIFICATION:
Recent reports have indicated that the instance of death or disability
due to leptospirosis is unusually high among sanitation workers,- who
are continually exposed to automotive exhaust and other hazardous
substances and conditions.

AN ACT to amend the general municipal law, in relation to disabilities
of sanitation department employees caused by leptospirosis
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The general municipal law is amended by adding a new
2 section 207-aa to read as follows:
3 § 207-aa. Disabilities of members of the uniformed force of sanitation
4 departments caused by leptospirosis. 1. Notwithstanding the provisions
5 of any general, special, or local law to the contrary, any condition of
6 impairment of health caused by leptospirosis that results in total or
7 partial disability or death to a paid member of the uniformed force of a
8 sanitation department, where such member is drawn from competitive civil
9 service lists and successfully passed a physical examination upon entry
10 into the service of such sanitation department, and such examination
11 failed to reveal any evidence of such condition, shall be presumptive
12 evidence that such condition was incurred in the performance and
13 discharge of such member's duty, unless competent evidence proves other-
14 wise.
15 2. The provisions of this section shall not apply to the workers'
16 compensation law and the labor law.
17 § 2. This act shall take effect immediately.
