TITLE OF BILL:
An act authorizing the town of Kinderhook to transfer ownership of
certain parkland to the Valatie Volunteer Rescue Squad, Inc.
 
PURPOSE:
Authorizes the town of Kinderhook to alienate certain parklands and to
convey such land at fair market value to the Valatie Volunteer Rescue
Squad Inc., to provide emergency medical services.
 
SUMMARY OF PROVISIONS:
Section one authorizes the Town of Kinderhook to convey town parkland to
Valatie Volunteer Rescue Squad, Inc. for the purpose of providing Emer-
gency Medical Services.
Section two describes the boundaries of the land to be conveyed.
Section three requires the Town of Kinderhook to meet with any federal
regulations pertaining to the alienation of parklands, if applicable.
Section four states the effective date.
 
JUSTIFICATION:
Valatie Volunteer Rescue Squad, Inc. provides vital EMS services to
multiple towns in Columbia County. The volunteer EMS squad's ability to
continue serving their community is unfortunately in jeopardy due to the
rapidly deteriorating state of their current facility. Soil oversatu-
ration has caused their septic system and floor drains to stop working,
and their building itself needs substantial repairs. The best solution
to resolve these issues in the long term is for the Valatie Volunteer
Rescue Squad to construct a facility on new land, which they have
arranged to do on land within the Town of Kinderhook. Because it was
originally state-owned land, the town requires state authorization to
convey it to the Valatie Volunteer Rescue Squad. This bill authorizes
the town to convey this land to them so that they can construct their
new facility and continue delivering vital EMS services.

AN ACT authorizing the town of Kinderhook to transfer ownership of
certain parkland to the Valatie Volunteer Rescue Squad, Inc.
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subject to the provisions of this act, the town of Kinder-
2 hook, county of Columbia, acting by and through its governing body, and
3 upon such terms and conditions as determined by such body, is hereby
4 authorized to discontinue as parklands and to sell and convey at fair
5 market value the lands described in section three of this act, to the
6 Valatie Volunteer Rescue Squad, Inc. for use by the Valatie Volunteer
7 Rescue Squad, Inc. for the purpose of providing emergency medical
8 services to the town of Kinderhook.
9 § 2. The authorization contained in section one of this act shall take
10 effect only upon the condition that the town of Kinderhook shall dedi-
11 cate an amount equal to or greater than the fair market value of the
12 parklands being discontinued towards the acquisition of new parklands
13 and/or capital improvements to existing park and recreational facili-
14 ties.
15 § 3. The parklands authorized to be alienated and discontinued as
16 parklands by the town of Kinderhook in section one of this act are
17 located, bounded and described as follows:
18 ALL that certain piece or parcel of land, situate, lying and being in
19 the Town of Kinderhook, County of Columbia, and State of New York,
20 bounded and described as follows:
21 BEGINNING at a steel pin at the southwesterly corner of the parcel
22 herein to be described, said point of beginning being at the southeast-

1 erly corner of the lands now or formerly of The State of New York said
2 point of beginning being further referenced as S 66°10'52" E a distance
3 of 380.86 feet from a steel pin on the easterly side of a Town of
4 Kinderhook highway commonly known as State Farm Road;
5 thence from said point of beginning and along lands of said State of New
6 York: N 34°15'00" E a distance of 456.84 feet to a point;
7 Thence through lands of the Town of Kinderhook on the following four
8 courses;
9 S 62°25'13" E a distance of 602.24 feet to a point;
10 S 32°59'21" W a distance of 370.14 feet to a point;
11 N 89°51'57" W a distance of 110.48 feet to a point;
12 N 66°10'52" W a distance of 523.50 feet to the point of beginning;
13 having an area of 261069.10 square feet or 5.99 acres of land.
14 § 4. In the event that the town of Kinderhook received any funding
15 support or assistance from the federal government for the purchase,
16 maintenance or improvement of the parklands set forth in section three
17 of this act, the discontinuance and alienation of such parkland author-
18 ized by the provisions of this act shall not occur until the town of
19 Kinderhook has complied with any federal requirements pertaining to the
20 alienation or conversion of parklands, including satisfying the secre-
21 tary of the interior that the alienation or conversion complies with all
22 conditions which the secretary of the interior deems necessary to ensure
23 the substitution of other lands shall be equivalent in fair market value
24 and usefulness to the lands being alienated or converted.
25 § 5. This act shall take effect immediately.
