NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A10151

SPONSOR: Hawley (MS)
TITLE OF BILL: An act to amend the judiciary law, in relation to compensation of certain district attorneys; and making an appropriation therefor   PURPOSE OR GENERAL IDEA OF BILL: This legislation provides reimbursement to counties for increases in district attorney salaries that are mandated by the state.   SUMMARY OF SPECIFIC PROVISIONS: Section 1 of this bill states that the state will be responsible for funding future increases to district attorney salaries. Section 2 of this bill appropriates $1.6 million for the reimbursement to counties as a result of the increased salaries for district attor- neys. Section 3 of this bill is the effective date.   JUSTIFICATION: In December 2015, the New York State Commission on Legislative, Judicial & Executive Compensation recommended increases in all state judges' salaries in 2016 and again in 2018, also requiring an increase for the salaries of county district attorneys. This places an unfunded mandate on counties as they must cover the cost of these raises.   PRIOR LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: Immediate cost of $1.6 million to the State to reimburse counties for the 2016 raise. Unknown future costs to the State to reimburse counties for future raises.   EFFECTIVE DATE: Immediately.
