TITLE OF BILL: An act to amend the judiciary law, in relation to
compensation of certain district attorneys; and making an appropriation

PURPOSE OR GENERAL IDEA OF BILL:
This legislation provides reimbursement to counties for increases in
district attorney salaries that are mandated by the state.
 
SUMMARY OF SPECIFIC PROVISIONS:
Section 1 of this bill states that the state will be responsible for
funding future increases to district attorney salaries.
Section 2 of this bill appropriates $1.6 million for the reimbursement
to counties as a result of the increased salaries for district attor-
neys.
Section 3 of this bill is the effective date.
 
JUSTIFICATION:
In December 2015, the New York State Commission on Legislative, Judicial
& Executive Compensation recommended increases in all state judges'
salaries in 2016 and again in 2018, also requiring an increase for the
salaries of county district attorneys. This places an unfunded mandate
on counties as they must cover the cost of these raises.

FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS:
Immediate cost of $1.6 million to the State to reimburse counties for
the 2016 raise. Unknown future costs to the State to reimburse counties
for future raises.

AN ACT to amend the judiciary law, in relation to compensation of
certain district attorneys; and making an appropriation therefor
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 183-a of the judiciary law, as amended by chapter
2 1049 of the laws of 1974, is amended to read as follows:
3 § 183-a. Compensation of certain district attorneys. Notwithstanding
4 any other provision of law, the district attorney of each county having
5 a population of more than five hundred thousand according to the last
6 federal census, exclusive of the counties of New York, Bronx, Kings,
7 Queens and Richmond, shall receive an annual salary equivalent to that
8 of a justice of the state supreme court together with such additional
9 compensation as the legislative body of such county may provide by local
10 law. Further, that the district attorney of each county having a popu-
11 lation of more than one hundred thousand and less than five hundred
12 thousand according to the last federal census, exclusive of the county
13 of Richmond, and the district attorney of any county, the board of
14 supervisors of which has designated such office as a full-time position
15 pursuant to subdivision eight of section seven hundred of the county
16 law, shall receive an annual salary equivalent to that of county judge
17 in the county in which the district attorney is elected or appointed,
18 together with such additional compensation as the legislative body of
19 such county may provide by local law. The state shall reimburse the
20 counties for the entire cost of any increase in the annual salary of a
21 district attorney due to an increase in the annual salary of a justice
22 of the supreme court or a county judge.
23 § 2. The sum of one million six hundred thousand dollars ($1,600,000)
24 is hereby appropriated out of any moneys in the general fund of the
25 state treasury to the credit of the state purposes account not otherwise
26 appropriated, for reimbursement to counties resulting from the increase
27 in salaries decided upon by the New York state commission on legisla-
28 tive, judicial & executive compensation.
29 § 3. This act shall take effect immediately.
