TITLE OF BILL:
An act in relation to authorizing Michael Kurtz to take the competitive
civil service examination for the position of police officer and be
placed on the eligible list for employment as a full-time police officer
for the village of Warsaw
 
PURPOSE:
To provide the Village of Warsaw the opportunity to offer Mr. Kurtz a
full time position with the village police department upon his satisfac-
tory performance on the relevant civil service examination.
 
SUMMARY OF PROVISIONS:
Section 1 of the bill deems Mr. Kurtz eligible to sit for the compet-
itive civil service examination for police officer and, contingent on
his score, shall be eligible to be placed on the list for appointment as
a full-time police officer for the Village of Warsaw.
Section 2 requires the candidate to be subject to all other relevant
provisions of the civil service law regarding police officers.
Section 3 provides the effective date.
 
EXISTING LAW:
Current law limits prospective candidates to those under the age of 35
years old.
 
JUSTIFICATION:
Michael Kurtz, a part-time police officer, has been granted by the
Village of Warsaw Police Chief, Chief Peter Hoffineister, and the Mayor
of the Village of Warsaw, Dan Burling, the opportunity to seek an age 0
based waiver to take the competitive examination to become a full-time
police officer with the Village of Warsaw Police Department. This legis-
lation would allow Mr. Kurtz to test for the full-time position, as
approved by the Village of Warsaw Police Chief and the Mayor of the
Village of Warsaw.

AN ACT in relation to authorizing Michael Kurtz to take the competitive
civil service examination for the position of police officer and be
placed on the eligible list for employment as a full-time police offi-
cer for the village of Warsaw
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Notwithstanding the provisions of section 58 of the civil
2 service law, including the age requirements under paragraph (a) of
3 subdivision 1 of such section, or any other provision of law to the
4 contrary, Michael Kurtz, who has been continuously employed by the
5 village of Warsaw, in the county of Wyoming, as a part-time police offi-
6 cer, shall be eligible to take the competitive civil service examination
7 for the position of police officer and shall, contingent upon his score
8 on such examination, be eligible to be placed on the eligible list for
9 appointment as a full-time police officer with the village of Warsaw
10 police department.
11 § 2. Michael Kurtz shall otherwise be subject to the merit and fitness
12 provisions of the civil service law applicable to full-time police offi-
13 cers.
14 § 3. This act shall take effect immediately.
