TITLE OF BILL:
An act to amend the executive law, in relation to hazardous materials
emergency response training for incidents involving lithium-ion
batteries
 
PURPOSE OR GENERAL IDEA OF BILL:
The purpose of this bill is to provide training regarding lithium-ion
battery emergency response.
 
SUMMARY OF PROVISIONS:
Section one of this bill would amend section 156-a of the Executive Law
by incorporating training regarding lithium-ion battery emergency
response into the Office of Fire Prevention and Control specialized
hazardous materials emergency response training program.
Section two would establish the effective date.
 
JUSTIFICATION:
Lithium-ion batteries are ever present in today's society, from e-bikes
to smart phones to laptops. Unfortunately, due to how they are
constructed, they are susceptible to catching fire, especially when they
are damaged. This bill ensures that there is specialized training avail-
able to first responders so they are equipped to handle an emergency
when it comes to these types of batteries.

AN ACT to amend the executive law, in relation to hazardous materials
emergency response training for incidents involving lithium-ion
batteries
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivisions 3 and 4 of section 156-a of the executive law
2 are renumbered subdivisions 4 and 5 and a new subdivision 3 is added to
3 read as follows:
4 3. Such specialized hazardous materials emergency response training
5 program curriculum shall also include guidance regarding emergency
6 response to incidents involving lithium-ion batteries. For the purposes
7 of this section, "lithium-ion battery" means a storage battery in which
8 an electrical current is generated by lithium ions embedded in a
9 carbon graphite nickel metal-oxide substrate placed in a high-viscosity
10 carbonate mixture or gelled polymer electrolyte.
11 § 2. This act shall take effect immediately.
