  TITLE OF BILL: An act to amend the general business law, in relation to the sale of bicycles with electric assist and electric scooters   PURPOSE OF BILL: The purpose of this bill is to require e-bikes and e-scooters be sold with a fireproof battery container.   SUMMARY OF SPECIFIC PROVISIONS: Section 1 of the bill adds new section 391-cc to the general business law to require e-bikes and e-scooters be sold with a fireproof battery container. Minimum requirements for fireproof battery containers will be set by the Division of Homeland Security and Emergency Services. Section 2 of the bill sets the effective date.   JUSTIFICATION: As e-bikes and e-scooters continue to proliferate, so do fires caused by their rechargeable batteries. According to FDNY.data, lithium-ion batteries caused 267 fires in 2023, a 20% increase from the previous year. These fires are especially dangerous because of their resistance to water and fire extinguishers. By requiring E-bike and e-scooter be sold with a fireproof container for the battery, their users will be provided with an important fire safety tool that can save lives.   PRIOR LEGISLATIVE HISTORY: New bill   FISCAL IMPLICATIONS: None   EFFECTIVE DATE: This act shall take effect 180 days after it shall have become a law ; provided, however, that effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized and directed to be made and completed by the commissioner of The division of homeland security and emergency services on or before such effective date.

GLICK -- read once and referred to the Committee on Consumer Affairs and Protection AN ACT to amend the general business law, in relation to the sale of bicycles with electric assist and electric scooters The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The general business law is amended by adding a new section 2 391-cc to read as follows: 3 § 391-cc. Sale of bicycles with electric assist and electric scooters. 4 1. For the purposes of this section, the following terms shall have the 5 following meanings: 6 (a) "Bicycle with electric assist" shall have the same meaning as 7 defined by section one hundred two-c of the vehicle and traffic law. 8 (b) "Electric scooter" shall have the same meaning as defined by 9 section one hundred fourteen-e of the vehicle and traffic law. 10 (c) "Fireproof battery container" shall mean a bag, box, blanket, or 11 other means of containing or covering a battery used as the principal 12 electric power source for a bicycle with electric assist or electric 13 scooter that is capable of resisting the effect of fire involving such 14 batteries and meets all minimum specifications as determined by the 15 division of homeland security and emergency services pursuant to subdi- 16 vision three of this section. 17 2. No person, firm, partnership, association, limited liability compa- 18 ny, corporation, or other entity shall sell or offer to sell a bicycle 19 with electric assist or electric scooter to a consumer unless such bicy- 20 cle with electric assist or electric scooter is sold with a fireproof 21 battery container for the safe storage of the battery used as the prin- 22 cipal electric power source. 23 3. The division of homeland security and emergency services shall 24 determine the minimum specifications and performance standards for fire- 25 proof battery containers under this section. 26 4. A violation of this section shall be punishable by a fine of two 27 hundred fifty dollars for a first violation, and five hundred dollars 28 for each subsequent violation.
