TITLE OF BILL:
An act to amend the general business law, in relation to exempting
correction officers of any penal correctional institution from training
requirements for security guards
 
PURPOSE:
Exempts correction officers of any penal correctional institution from
training requirements for security guards.
 
SUMMARY OF PROVISIONS:
Section one amends paragraphs a of subdivision 4 of section 89-n of the
general business law to add correction officers of any penal correction-
al institution to the list of those exempted from training requirements
for security guards.
Section two is the effective date.
 
JUSTIFICATION:
Currently, the laws governing licensing of security guards require
certain training requirements to ensure security guards are knowledge-
able in the duties they will perform. However, certain persons who have
the title of police or peace officer are either exempt from these train-
ing requirements or are granted waivers for these requirements.
The exempt titles include police officers, NYS Correction Officers,
Bridge and Tunnel officers, sergeants and lieutenants, uniformed court
officers, court clerks with peace officer status and NYC sheriffs.
Pursuant to current law, NYS uniformed correction personnel are specif-
ically designated to receive the exemption.
This legislation would specifically include the uniformed correction
officers of any penal correctional institution who are duly qualified as
peace officers under New York State law within the exemption.
 
FISCAL IMPLICATIONS:
None.
 
EFFECTIVE DATE:
This act shall take effect immediately.

AN ACT to amend the general business law, in relation to exempting
correction officers of any penal correctional institution from train-
ing requirements for security guards
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph a of subdivision 4 of section 89-n of the general
2 business law, as amended by chapter 221 of the laws of 2003, is amended
3 to read as follows:
4 a. a correction officer of any state correctional facility or of any
5 penal correctional institution having the powers of a peace officer
6 pursuant to subdivision twenty-five of section 2.10 of the criminal
7 procedure law;
8 § 2. This act shall take effect immediately.
