An act to amend the vehicle and traffic law, in relation to permitting

PURPOSE:
Permits the use of ATVs on certain roadways in the county of Wayne
SUMMARY OF PROVISIONS:
Section 1: amends Section 2405 of the vehicle and traffic law is amended
by adding a new subdivision 1-a.
Section 2: effective date.
JUSTIFICATION:
In recent years the lack of snow has hindered the snowmobiling opportu-
nities across the State, including this sectipn of trail in Wayne Coun-
ty. As snowmobiling becomes less accessible in our County, we need to
find ways to still promote outdoor enthusiasm. This legislation would
help to better utilize the land and help promote the 'isage of All-Ter-
rain vehicles. We will see an increase in sales in ATV and help spur the
local restaurants and shops that operate along this corridor.

AN ACT to amend the vehicle and traffic law, in relation to permitting
ATV use on certain roadways in the county of Wayne
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 2405 of the vehicle and traffic law is amended by
2 adding a new subdivision 1-a to read as follows:
3 1-a. Exceptions. Notwithstanding the provisions of subdivision one of
4 this section, the commissioner, with the concurrence of the commissioner
5 of transportation, shall designate for temporary ATV use the trail
6 located on state route one hundred four between the western county line
7 of Wayne county and the northern town line of the town of Hannibal in
8 Oswego county. The commissioner's designation shall include conditions,
9 developed in consultation with the commissioner of transportation, on
10 the use of such trail by ATVs to provide for the safe use of such route
11 and the safe operation of ATVs on the trail. Designations made under
12 this subdivision shall be effective for no longer than a period of one
13 year and may be renewed with the concurrence of the commissioner of
14 transportation.
15 § 2. This act shall take effect immediately.
