Assemblyman Santabarbara Introduces Bill to Exempt Shipping and Delivery Fees from Sales Tax

Assemblyman Angelo Santabarbara announced new legislation he has introduced in the State Assembly that would exempt shipping and delivery fees from being included when sales tax is calculated for a transaction to customers in New York State.

Currently, according to the New York State Department of Taxation and Finance, charges for shipping or delivery that a seller includes on its bill are taxable if the product or service that is being shipped or delivered is taxable. This legislation would protect consumers by allowing them to save more of their hard-earned money by paying sales tax only on the goods being delivered, not their shipping and delivery fees.

“During these times of inflation and rising costs on many essential items, our state government needs to look at ways to let working families save more of their hard-earned money,” said Assemblyman Angelo Santabarbara.

“With the rise of online shopping, many essential items are now delivered right to our doorsteps. The state should start to give consumers some much needed relief by not adding on burdensome taxes to shipping and delivery fees,” Assemblyman Santabarbara added.

Additionally, many senior citizens, as well as people with disabilities, rely on goods being delivered to their homes. This legislation will ensure that people who rely on delivery will not be taxed extra just for shipping costs, but only for the product they purchased.
